The Role of lawyers in indias freedom struggle THE ROLE OF LAWYERS IN INDIAS FREEDOM STRUGGLE 1885 was a remarkable year in the history of India, a year which would determine the future of India, a new chapter in the freedom struggle started as a mass movement in 1857 by the ‘sepoy mutiny. With the joint efforts of A.O. Hume and W.C. Bonnerjee, the Indian National Congress was established. This brought the Indian intelligentsia into the main stream of the movement for freedom. This gave people a platform to discuss and share their grievances and in turn device a plan of action. This was the first time that Indians realized that violence was not the only means of fighting a battle and in the years to come ahimsa and satyagraha would become the two pillars on which the freedom struggle rests. How different would the history of India be, had the intelligentsia not taken over the freedom struggle. It was a war of independence from the shackles of enslavement of two centuries. It was a war of rights and liberties. It was a war for establishing ones independent identity. It was a war against injustice and inequality; against racialism and cruelty. The war against the British was not a war of arms but a war or strategy and mental strength. Most of all it was a war of ‘words. Who better to fight such a war but the magicians of words, those who have words for tool, just words to earn their livelihood lawyers. India even in another century could not have gathered enough to make an army stronger than the British. The rich were too busy match fixing the future of India with the British and the poor were too poor to put together two square meals forget about a rebellion against the mighty British Empire. This was the time when the educated middle class came to the fore. It was these, educated men and women who decided to fight the empire for they needed to get jobs, they worried for the future of their children and the future of India, they needed to be independent, they were in contact with the west and they were the so called â€Å"enlightened† ones. These constituted lawyers, teachers, doctors, civil servants etc. Their only strength was their education and they decided to play a game of wits and not of weaponry to get Indians their long due freedom. They realized that what India needed was direction, an understanding of rights, unity, a new form of warfare, which was non violent, leaders and focus. Of this intelligentsia lawyers were the ones who led the struggle from the front, the reasons for this were many. First of all they were not government employees unlike the teachers, doctors and civil servants, so there was no obligation to follow directions from the government. Secondly, if lawyers could boycott courts, it would be a directly defying the British government and law and in turn it would directly imply that the rest of the population were not obliged to follow these laws. Thirdly, most of the lawyers had studied in England and they were aware of the English legal system and of the position people had in an independent nation. Also, they knew how to talk their way through to the English. They knew their weaknesses and strengths, and could successfully device a way to play the weaknesses of the British to their advantage. They were aware of the common law system keeping rights and duties on a pedestal and thus they used the cruelty and in humanity of the British in India to gain sympathy and in turn get the British in England to detest their own people and their conduct in India. Besides fighting cases in the law courts for the extremists who would regularly invite prosecution against themselves, most lawyers formed a group of moderate freedom fighters. They knew that India was not ready for immediate freedom and if India was to attain independence instantaneously, if would crumble without a strong center and there was no system and definitely no individual who could hold the country together. Since the lawyers had supreme understanding of the complicated and intricate laws that were being sent to India for the formation of government and for the administration of justice, they were best suited to discuss their implication and to repeal them as well as draw the English lawmakers to a point of making the law as pro Indians as possible. All these lawyers were of the view that an unjust law must be defied and repealed. Most of all, they advocated for social justice, equality and human rights. Soon, law courts became the preferred battlefield for Indians. Even an extremist revolutionary like Bhagat Singh took the help of a trial to send his message across. Infact, he deliberately invited a trial against him by throwing smoke bombs in the legislative assembly and surrendering himself to the police. The purpose that such court trials served was that they gave the freedom fighters an opportunity to come in contact with the media. The media would report the pleadings and comments in the local as well as the newspapers in England, this served a dual purpose the Indians got their leaders messages and the masses got provoked also, a sense of shame, regret and disapproval was spread amongst the British nationals in England. Though it is not preferred to earmark a single leader of the independence struggle but, if this was to be done, the name of Mohandas Karamchand Gandhi would top the list. A lawyer by profession studied in England and worked in South Africa. He was the first leader to fight the inhuman practice of apartheid in South Africa. On his return to India, he devised a practical approach. He first decided to tour through India and then come into the movement. This shows the typical trait of a lawyer, first put together the facts and investigation and then take up the case. Or differently put, when I dont know the laws of the land how do I fight a case? Then he took the movement head on. He advocated the disobedience of unjust laws, peaceful demonstrations, boycott of foreign goods and the peaceful picketing of shops selling foreign goods. His ideas eventually found shape in a non-cooperation launched later. His aim was to make the British administration come to a standstill, a point from which they would have to negotiate. He believed that a peaceful struggle was far more productive then a violent one. A peaceful struggle cannot be suppressed easily and is always sustainable in the long run. Mahatma Gandhi was able to take the freedom struggle to the masses and was a major advocate of social justice and unity amongst all sections of the Indian people. Finally talking of the biggest contribution of the British to India we cannot ignore the role played by the lawyer turned freedom fighters. Besides winning independence, these men extracted a lot from the British. Most important being: their administrative policy, their form of governance and their laws. Most of the English laws have formed the basis of our statute books and the parliamentary form of government was also due to the British influence. The Indian Penal Code, one of the most intricate and elaborate penal law books in the world can be considered a gift from the British. Talking of the form of government, the efforts of Nehru committee and Sapru committee on how to accommodate both the Hindu and Muslim representatives in the government posts was an effort worth applauding. Finally, on 15th August 1947, India won independence and at the same time India was divided and Pakistan was born. But, it was not over for the lawyers yet, on either sides. Jawaharlal Nehru became the first Prime Minister of independent India and across the border M.A Jinnah held the reins of Pakistan in his hands. The most remarkable contribution of Sardar Vallabhbhai Patel at this time in history was undoubtedly his efforts of unifying India as India was divided amongst provinces and princely states. But, it seems to me that the new age lawyers are not as aware or socially responsible as those sixty years ago. The size of your dog, also, depends on how strong you need to make it. You also need to ask yourself â€Å"How long is my dog going to stay in this kennel? † As I mentioned before, it is not a good idea to make the kennel your dog's permanent home. It causes anxiety in your dog. It also causes behavioral differences in your dog. Okay, let's get started. First, you will need to get supplies. Now most of the supplies can be bought at a local feed store or a local hardware store. You will need the following: Wooden Support Poles. You want these poles to be 6 ft high and at least 4 inches at the base. Unless you have a big dog, then you want to go taller with the posts. We don't want the dog to jump out of his cage and cause a unpleasant mess. U-nails is also required. These will help hold your fence in place. You will also need fencing. The experts prefer you to use portable metal fencing. You will need a gate for your kennel. This gate needs to be heavy and with a latch. That way your pooch can't push it open and escape. Finally, you will need a hammer and a screwdriver. Next, you will need to measure out where you are going to put this kennel. You need to make sure that it is big enough so your dog can run around yet not so big it inhibits your whole yard. Then you go and buy your materials. Remember that your yard is outside and should be able to withstand the forces of nature. Pick your spot. Make sure that there is shade and sunlight. A grassy yard is a good thing. It helps recycle the dog's urine and feces well. You also want to make sure that when it rains, it isn't going to fill up with mud and puddles. These can cause serious problems for your pet. This creates a problem. My dog manages to push the concrete bricks, that are holding the gate shut, out of the way. With a latch, I wouldn't be having this problem. I have stated previously that I have a backyard kennel made almost exactly like the one I described. I found that it doesn't work very well. I have a wolf breed type of dog and she digs out from under the fence. My suggestion would be to lay concrete down and make sure the fence is in the concrete. Also, with a large breed dog, you will want to make sure that it is high enough so your dog will not crawl out of it. We have had that problem as well. I searched for different sites to help me write the best description of a backyard kennel and found only one. It is apparent that most sites do not recommend putting your pet outside in an enclosure. I, personally, am one that doesn't find anything wrong with it. I tried to let my dog inside and she ate my house. She likes being outside. Unfortunately, she likes to be UNDER our house and that is not acceptable. So we built her a dog yard with house and a porch and a canteen area. I refuse to put air conditioning in her house. We have a state-of-the-art dog house that is under a perfect shade tree. The idea of man as monster is one perpetually peddled not only by Gothic writers, but throughout literature; Shelley toys with the concept in Frankenstein, and Shakespeare himself explores the dark fringes of humanity in character such as Richard III. Yet Macbeth is not quite so simple – whilst he certainly possesses irredeemably features, it is difficult to bracket him with the Duke of Gloucester; similarly, though he begins the play a hero, his descent cannot be easily compared to that of the archetypal tragic hero Othello. Rather, he is a complex hybrid, challenging audiences and critics to consider the nature and definition of monstrosity itself. Perhaps Macbeth's most ‘monstrous' feature is his ambivalence to his own tyranny; whilst the natural order of Scotland is turned upside down, he acknowledges that he is ‘in blood stepp'd in so far that should I wade no more, returning were as tedious as go o'er'. Here, Shakespeare summons a viscerally violent image of Macbeth wading in a river or lake of ‘blood' before having him casually dismiss it as ‘tedious'; the contrast of surreal horror and offhand flippancy highlighting what would appear to be Macbeth's complete lack of empathy. Combine this with the fact that, in the context of production, Macbeth's regicide would have represented one of the greatest possible breaches not only of judicial but of moral code, and his fate as a character seems sealed. Before Macbeth has committed any physical crime, Lady Macbeth cries for dark spirits to ‘unsex [her]' – the use of a compound adjective such as ‘unsex' representing – in it's linguistic irregularity as much as in its meaning – a total betrayal of all that it means to be human; to have a predetermined biology. In breaking the bonds of gender, Lady Macbeth finds the ability to foster ambition in Macbeth with sexually provocative blackmail (‘When you durst do it, then you were a man! ‘); perhaps Shakespeare's suggestion is that Macbeth only acts as a vessel for evil, whereas the witches, and Lady Macbeth, both of whom actively embrace the supernatural, represent the seed of evil which can take root in a man even as ‘brave' and ‘noble' as the formerly heroic Macbeth. To brand Macbeth as a monster feels far too simplistic; though, if Macbeth is to be viewed as a pre-Gothic text, the interpretation of him as an archetypal villain is understandable, this is an aspect of the play in which the imposition of a stylistic code feels reductionist and irrelevant. Instead, Macbeth ought to be viewed as a complex character in his own right, whose actions and words throw up as many conundrums as the critic or audience member may hope to find.

Everyone everywhere feels sadness. Whether it is everyday, or every once in a while, it is a feeling shared by all. In John Keats’ â€Å"Ode on Melancholy†, the poet expresses his views on the emotion and a mood of balance is conveyed with the help of the philosophy of the speaker, the language used and the overall message conveyed. First of all, the perspective that the poet takes when viewing the subject of melancholy creates and supports the balanced atmosphere. The poet is the speaker and he is speaking to someone, everyone, suffering from melancholy. He is informing them about how to deal with their natural feeling. In the first stanza of the poem the poet dissuades the victim of melancholy from ignoring their sadness: do not commit suicide. He is telling the melancholy people how not to treat their melancholy. He mentions that melancholy is so heavy and poisonous that ignoring it will only make it worse; victims have to abandon their negative-ness toward melancholy. In the second stanza, he says that when melancholy strikes, one must embrace it – allow himself to feel it; this is the only way to deal with it. He is presenting possible ways to deal with the melancholy. The third stanza says that melancholy, beauty, pleasure and joy are linked. Only by feeling melancholy, can one feel joy, and vice versa. The poet’s philosophy on melancholy is that only by experiencing it and accepting it can one truly appreciate and recognize joy. This is the solution to the problem of melancholy – this is how one should treat their melancholy. Thus, the poet’s point of view on the issue of melancholies, based on a balance of emotions, helps evoke a mood of equilibrium. Secondly, the language used in the poem also helps bring about a balanced atmosphere. The first stanza begins with â€Å"No, no, go,† low frequency, negative, gloomy sounds that evoke the feeling of melancholy. There are several negative images that follow. There is an allusion to Lethe, the River of Forgetfulness in Greek mythology. Other allusions to Greek mythology are Proserpine or Persephone, goddess of the underworld and Psyche who is commonly associated with the soul. The reference to Persephone reflects how Keats feels about melancholy. Like Persephone’s obligation to spend half the year in the underworld and the other on the face of the earth, melancholy can be seen as partly bad but partly good as well, since without knowing how melancholy feels, one would not know how joy feels. Poisonous plants like wolf’s-bane, nightshade and yew-berries are mentioned – likened to melancholy. At the end of the first stanza, there are low frequency sounds on the words â€Å"anguish of the soul†. This draws out the line and puts emphasis on its meaning. In the second stanza there is a simile, likening melancholy to a cloud that has fallen from the sky – heaven to be precise. Heaven is a positive word, associated with where melancholy comes from in the poem. This juxtaposition of positive and negative images also helps to enforce the point that melancholy and joy are connected. Further evidence of this is the term â€Å"weeping cloud† that implies rain, which is usually associated with dreariness, but in truth it also nourishes – it â€Å"fosters the droop-headed flowers†. The mention of the â€Å"droop-headed† flowers is sad, but the nurturing of them is happy. The mention of the word â€Å"rainbow† in line six of the second stanza adds even more reinforcement to this idea. The word â€Å"rain† has a high frequency sound – a happier sound, whereas the word â€Å"bow† has a lower frequency sound – a gloomier sound. On top of this, a rainbow requires both sun and rain to occur. The phrase â€Å"April shroud† also contains contrasts. â€Å"April† implies spring, life and happiness, whereas â€Å"shroud† implies death. Positive images that flood the senses are featured on lines five to seven. These counterbalance the negative images featured in the first stanza. There is a pun on the word â€Å"morning† in the seventh line – it could also be taken as â€Å"mourning† which is a contrasting word to â€Å"morning†. In the eighth line of the second stanza melancholy is personified. The poet refers to it as â€Å"mistress† and â€Å"her†. The term â€Å"rich anger† is used. It is a paradox, and it enforces the idea of balance. In the last line of the second stanza, the words â€Å"feed deep, deep† are employed. They all contain high frequency sounds, which give off the feeling of energy, which contrasts the melancholy. The term â€Å"peerless eyes† in the last line is a pun since it could mean that no one can match those eyes, or it could also mean that the eyes are unable to perceive. The third stanza continues the personification of melancholy. However, Beauty, Joy, Pleasure and Poison are personified as well. The poet says that Beauty, Melancholy and Joy go hand in hand in hand. The mention of the word â€Å"die† in line one of the third stanza is a negative image. There is an enjambment from line two to line three. The word â€Å"adieu† in line three of the third stanza also proposes a negative image. In line four of the second stanza, the word â€Å"poison† is used in conjunction with the term â€Å"bee-mouth†. The â€Å"bee-mouth† is a delicate image, whereas poison is a cruder one. On the last line of the poem the contrasting term â€Å"cloudy trophies† is used. Hence, the language employed in the poem, the balance of happy and sad, positive and negative helps create and maintain the mood of equality of the poem. Finally the overall message that is conveyed aids with achieving the sense of balance present in the poem. The theme of the poem is that in life everything is balanced, to value joy, one must have encountered sorrow. In order to identify beauty, one must have seen ugliness.
